Misdemeanor classes under Virginia law

Under Virginia law, misdemeanors are divided into the following four classes, with Class 1 including the misdemeanor crimes that are punished most harshly:

  • Class 1 — If you are found guilty of a Class 1 misdemeanor, you could spend up to one year in jail and be forced to pay a fine as high as $2,500. A DUI charge where no aggravating factors exist is in this category. Petit larceny, where the value of the items allegedly stolen is less than $1,000, is also a Class 1 misdemeanor, along with simple assault and disorderly conduct.
  • Class 2 — The top penalty for a Class 2 misdemeanor is six months of incarceration and a maximum $500 fine. Unauthorized possession of a Schedule IV controlled substance, which includes several common prescription drugs, is in this class. You can also face these penalties for driving a vehicle without a license and some other traffic violations.
  • Class 3 — There is no jail sentence associated with a conviction for a Class 3 misdemeanor. However, you might be fined as much as $500. This group includes Schedule V drug possession charges and protective order violations.
  • Class 4 — Public intoxication counts and other Class 4 misdemeanors are punishable by a maximum $250 fine.
